The OECD Standard for Automatic Exchange of Financial Information in Tax Matters (the “OECD Standard”) significantly extends the scope of the automatic exchange of information vis-à-vis the EU Savings Directive. Nearly 100 jurisdictions have committed to implement it and a Directive has already been adopted to integrate it into EU law.
Its implementation will result in a vast array of obligations vesting upon financial institutions, which will increasingly act as auxiliary to the tax authorities. The regulatory framework represents a complex blend of KYC, tax, legal and IT provisions that solicits a wide range of expertise within each financial institution. The ambitious implementation timeframe leaves financial institutions with a much shorter timespan than for FATCA to complete their implementation projects. New account opening procedures to record tax residence will need to be in place from 1 January 2016. Certain due diligence procedures will be required to be completed by 31 December 2016. Reporting will start in 2017.
